MetroLuxium provides restaurant customer retention analytics tools and related services designed to help restaurants understand customer behaviour, improve retention rates, and optimise revenue. Our services include data analytics platforms, reporting tools, customer segmentation capabilities, and strategic consulting services.

User Obligations

As a user of our services, you agree to:

  • Provide accurate, current, and complete information when creating accounts or using our services
  • Maintain the security and confidentiality of your account credentials
  • Use our services only for lawful purposes and in accordance with these Terms
  • Comply with all applicable laws and regulations in your use of our services
  • Not interfere with or disrupt the integrity or performance of our services
  • Not attempt to gain unauthorised access to our systems or other users' data
  • Respect the intellectual property rights of MetroLuxium and third parties
  • Provide accurate customer data and ensure you have appropriate consent for data processing

Payment Terms

Service fees are payable in advance according to your selected subscription plan. All fees are non-refundable except as expressly stated in these Terms or required by law. We reserve the right to modify our pricing with thirty (30) days' notice. Failure to pay fees may result in suspension or termination of your access to our services.

Data Protection and Privacy

We are committed to protecting your privacy and the privacy of your customers. Our collection, use, and protection of personal data is governed by our Privacy Policy, which forms part of these Terms. You are responsible for ensuring that any customer data you provide to us is collected and shared in compliance with applicable data protection laws.

Intellectual Property

All content, features, and functionality of our services, including but not limited to software, text, graphics, logos, images, and algorithms, are owned by MetroLuxium or our licensors and are protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use our services in accordance with these Terms. You may not copy, modify, distribute, sell, or lease any part of our services without our express written consent.

Confidentiality

Both parties acknowledge that they may have access to confidential information. You agree to maintain the confidentiality of any proprietary information about MetroLuxium, our services, or our business operations. We agree to maintain the confidentiality of your business data and customer information in accordance with our Privacy Policy and applicable data protection laws.

Limitation of Liability

To the fullest extent permitted by law, MetroLuxium shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising from or related to your use of our services. Our total liability for any claims arising from these Terms or your use of our services shall not exceed the amount paid by you to MetroLuxium in the twelve (12) months preceding the claim.

We provide our services "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that our services will be uninterrupted, error-free, or completely secure.

Indemnification

You agree to indemnify, defend, and hold harmless MetroLuxium, its officers, directors, employees, and agents from and against any claims, damages, losses, costs, and expenses (including reasonable legal fees) arising from your use of our services, violation of these Terms, or infringement of any third-party rights.

Governing Law

These Terms are governed by and construed in accordance with the laws of Portugal, without regard to conflict of law principles. Any disputes arising from these Terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of Lisbon, Portugal. If you are a consumer resident in the European Union, you may also bring proceedings in the courts of your country of residence.

Termination

Either party may terminate these Terms at any time with thirty (30) days' written notice. We may terminate your access immediately if you breach these Terms or engage in conduct that we reasonably believe is harmful to our business or other users. Upon termination, your right to use our services will cease immediately, but provisions regarding intellectual property, confidentiality, limitation of liability, and governing law will survive termination.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect and enforceable.

Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published on our website, constitute the entire agreement between you and MetroLuxium regarding your use of our services and supersede all prior agreements and understandings.
